When it comes to penalties, the difference between the MSPB and arbitrators is significant. Arbitrators often consider "Daugherty's Seven Tests." For the MSPB, there's mitigation and the Douglas factors. Many arbitrators may consider Douglas standards in their cases, but arbitrators lack uniformity in their major adverse action awards because they cannot be appealed to the MSPB — except in limited circumstances — or the FLRA.
